MOBILE APPLICATION PRIVACY POLICY

 

Introduction

The Center for COVID Control LLC (“CCC,” “we” or “us”) is committed to protecting your privacy. This Privacy Policy (“Policy”) explains how information about you or associated with you is collected, used and disclosed by CCC and its affiliates. This Policy applies to our mobile app for iPhone, Windows and Android mobile devices (collectively, the “App”). By accessing or using the App, you signify that you have read, understood and agree to our collection, storage, use and disclosure of your personal information as described in this Policy.

 

“You” or “Your” means a user of the App, which could refer to an individual, an employer, an employee, an employee associated with an employer account, or any other authorized user of the App.

 

Your Information

We collect information from and about users of our App:

  • Directly from you when you provide it to us.

  • Automatically when you use the App.

 

When you download, register with, or use this App, we may ask you to provide information:

  • By which you may be personally identified, such as name, postal address, email address, telephone number, social security number, as well as information related to your medical history, including information that is considered “protected health information” under certain state laws and federal laws such as HIPAA and HITECH (collectively, "PHI").

  • That is about you but individually does not identify you such as certain demographic information.

 

The Information we collect includes, but is not limited to: 

  • Information that you provide by filling in forms in the App. This includes information provided at the time of registering to use the App. We may also ask you for information when you report a problem with the App.

  • Information collected from you during your use of the App.

  • Information submitted by your employer 

  • Information submitted by you approved health care providers.

  • Information submitted by third parties.

  • Information you provide related to persons you consent to share your PHI with, such as family members, care-takers, or medical professionals, as well as any communications between you and such persons.

  • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.

  • Your responses to surveys that we might ask you to complete for research purposes.

  • Details of transactions you carry out through the App and of the fulfillment of your requests.

  • Your search queries on the App.

 

Automatic Information Collection and Tracking

When you download, access, and use the App, it may use technology to automatically collect:

 

  • Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, logs, and other communication data and the resources that you access and use on or through the App.

  • Device Information. We may collect information about your mobile device and internet connection, including the device's unique device identifier, IP address, operating system, browser type, mobile network information, and the device's telephone number.

  • Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.

  • Location Information. This App does not collect real-time information about the location of your device.

  • Cookies. As you interact with our website, we may automatically collect technical data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies. We may also receive technical data about you if you visit other websites employing our cookies. If you do not want us to collect this information, do not download the App or delete it from your device. 

 

We also may use these technologies to collect information about your activities over time and across third-party websites, apps, or other online services (behavioral tracking). 

 

How We Use Your Information

We use information that we collect about you or that you provide to us, including any PHI, to:

  • Provide you with the App and its contents, and any other information, products or services that you request from us.

  • Fulfill any other purpose for which you provide it.

  • Give you notices about your account, including expiration and renewal notices.

  • Carry out our obligations and enforce our rights arising from any contracts or agreements entered into between you and us.

  • Notify you when App updates are available, and of changes to any products or services we offer or provide though it.

 

The usage information we collect helps us to improve our App and to deliver a better and more personalized experience by enabling us to:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences, allowing us to customize our App according to your individual preferences.

  • Speed up your searches.

  • Recognize you when you use the App.

 

We may compile analytics and share performance data on a de-identified or aggregate basis. We may send you communications that contain information about the App, other products or services, or information about third parties’ products or services we think you may enjoy.

 

Disclosure of Information and PHI

We may share your personal information in the instances described below. For further information on your choices regarding your information, see the “Your Choices Regarding Your Information” section below.

 

We may share your personal information or PHI with:

  • Other members of the App. Your information will be shared other users of the App, as needed to provide the App to you. For example, some of your information may be shared with your employer and with other employees of the same employer. You may be able to control the visibility of some of your information and actions through your Settings (see “Your Choices Regarding Your Information” below). 

  • With third parties with your consent. From time to time, we may provide an opportunity to share your information with one of our third party partners or other individuals. We will ask for your consent before engaging in this type of sharing;

  • Other companies owned by or under common ownership as CCC, which also includes our subsidiaries (i.e., any organization we own or control) or our ultimate holding company (i.e., any organization that owns or controls us) and any subsidiaries it owns. These companies will use your personal information in the same way as we can under this Policy;

  • Third party vendors, consultants and other service providers that perform services on our behalf, in order to carry out their work for us, which may include identifying and serving targeted advertisements, hosting services, or providing analytics services;

  • Other parties in connection with any company transaction, such as a merger, sale of all or a portion of company assets or shares, reorganization, financing, change of control or acquisition of all or a portion of our business by another company or third party or in the event of bankruptcy or related or similar proceedings; and

  • Third parties as required to (i) satisfy any applicable law, regulation, subpoena/court order, legal process or other government request, (ii) enforce our Terms and Conditions, including the investigation of potential violations thereof, (iii) investigate and defend ourselves against any third party claims or allegations, (iv) protect against harm to the rights, property or safety of CCC, its users or the public as required or permitted by law and (v) detect, prevent or otherwise address criminal (including fraud or stalking), security or technical issues.

 

We may also share information with others in an aggregated and anonymous form that does not reasonably identify you directly as an individual.

 

Data Security

 

We have implemented technical, physical, administrative and organizational measures designed to secure your PHI and other personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls which conform to applicable state and federal regulations.

 

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password or security pin number for access to certain parts of our App, you are responsible for keeping this password confidential. Do not to share your password with anyone.

 

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your PHI and other personal information, we cannot guarantee the security of your PHI and other personal information transmitted through our App. Any transmission of PHI and other personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

 

Retention

We will retain your information for as long as your account is active or as needed to for our internal purposes. When you deactivate your account, including if you are removed from an employer’s company account, we will remove your information from view by others on the App but we may retain your account information internally so that you can access your account history through an individual account and so that you may re-register your account or an account with another employer more quickly in the future. You may request to delete your account information by contacting us at contact@centerforcovidcontrol.org. However, please be aware that we will not be able to delete any content you have shared with others on the App.

 

Updates to this Policy

We reserve the right to modify this Policy, including any region-specific disclosures referenced herein, from time to time. If we make any changes to this Policy, we will post the updated Policy. If you object to any changes, you may close your account. Continuing to use our App after we publish changes to this Policy means that you are consenting to the changes.
